Community Trust Bank VISA® Gift Card

By purchasing, receiving and/or using this Community Trust Bank VISA® Gift Card, You agree to be bound by the Terms and Conditions of this Agreement. As used in these Terms and Conditions "You" or "Your" means the person who has purchased, received and/or signed the back of the Community Trust Bank Visa Gift Card; "We", "Us" or "Our" means Community Trust Bank. Our successors, affiliates or assigns; "Card" means the Community Trust Bank VISA® Gift Card. Please read the following carefully and keep for Your records.

The Card is a proprietary form of a Visa® prepaid debit card. The Card accesses a special pre-paid payment facility You have opened by delivering funds to Us for use by this Card. The Card is not linked to nor does it access, in any way, any checking or other accounts at our Bank. The Card is not a credit card. No interest will be paid on the balances transferred to the Card and such balances are not FDIC insured. The Card has a maximum value of the amount you purchase. You may purchase a Card for a minimum value of $10 Dollars, or up to a maximum value of $500 Dollars. When you use the Card, the amount of any purchase or cash withdrawal will be deducted from the Card and its value will be reduced. You may only use the Card when there is a balance remaining after deducting all previous purchases and cash withdrawals You have made from the amount of the original value of the Card and then only up to the amount left on the Card. Purchases will be deducted from Your Community Trust Bank Visa® Gift Card until the value reaches zero.

Please note there may be a delay in initial funding of the Card or payment facility not to exceed the end of the next business day after the initial purchase. 

Activation: To activate your card call the toll free Community Trust Customer Care Center number at 1-866-297-3613. You will need to use the card number and the CVV number found on the back of the card. You will also then select your Personal Identification Number (PIN) to a new 4-digit number of your selection.

Card Acceptance and Registration

Before using your Card, we recommend that you register as the recipient of the Card at https://www.onlinecardaccess.com/ctbonlinegift.  You will not be able to do a mail/telephone order or online purchases without registering your Card.  In order to be eligible for Visa's ® zero liability coverage you must be able to prove ownership of the card.  If you do not register, you may not be able to establish that you are the owner of a Card that is lost or stolen.

Card Usage and Limitations

Point-of-Sale Transactions.  The card can be used anywhere Visa® and NYCE debit cards are accepted to pay for goods and services. The Card cannot be used to obtain cash at an ATM, or to make a preauthorized regular payment.  When you use the Card to obtain goods or services the merchant may attempt to obtain preauthorization from the Card for the transaction.  A three (3) day hold will be placed on the Card for the preauthorized amount, which means those funds may not be used for any other purpose during the hold period.  If the preauthorization request varies from the amount of the actual transaction, payment of the transaction may not remove the hold, which may remain on the funds in the payment facility associated with the Card until three (3) days have expired.

Once you have registered and signed the back of your Card, it is non transferable.  If you permit someone else to use your Card, we will treat this as if you have authorized this person to use your Card and you will be responsible for any transactions initiated by such person with your Card.

The amount available on your Card will be reduced by the amount of any purchase or cash advance.  The card is not reloadable and cannot be re-used once the balance has been depleted. 

Card Use at a Gas Station.  You may use your card at a Gas Station, however, you must pay with the Card at the cashier.  The Card cannot be used for "Pay at the Pump" transactions. 

Card Use at a Merchant.  You may use your Card at a Merchant who has agreed to accept Visa® or NYCE debit transactions.

Purchases that exceed the Value on the Card.   If the amount of your purchase is greater than the amount available on your Card, the difference may be paid with another form of payment, depending on the merchant's policy.  Any transaction attempted for more than the amount available on the Card will be declined.  You must know the available balance on your Card and inform the merchant to process the transaction in that amount. 

Card Use at a Restaurant.  When using the Card at a restaurant, a gratuity of up to 25% may automatically be added to the total amount of the bill at the time of authorization through the credit card terminal.  This is to ensure that you have funds available to cover the total bill plus a tip.  Your Card will not be charged the calculated tip should you choose to pay a different tip amount or pay the tip in cash.  To avoid any problems at the time of authorization, make sure the total amount of the bill, including any tips, does not exceed the balance remaining on your Card. 

Card Use for Cash Advance.  You may use your Card to obtain a cash advance from a financial institution that accepts Visa® branded cards.  You will be charged a fee of $3.00 for cash advances. However a fee of 5.97 for International cash advances may also be assessed.  

Foreign Currency Transactions.  If you use your Card for a transaction in a foreign currency, the transaction will be converted to U.S. dollars in accordance with the applicable Visa® operating regulations for international transactions.  Currently, those regulations provide that the exchange rate will be either a government-mandated rate or the wholesale market rate in effect one day prior to the transaction processing date, increased by one percent 1%.  We do not control the rate, date or place of exchange and the conversion rate used may be a rate in effect on a later date than the transaction date.  

Damaged Card.   Please visit any Community Trust Bank banking center. We will be happy to advance the money to you from your damaged card at no cost.  You are welcome to purchase a new card to replace that card if you so choose.

The use of your Card to purchase goods and services constitutes a simultaneous withdrawal of the funds available on the Card, even though transactions may not actually be posted until a later date.  You do not have the right to stop payment on any transaction originated by use of your Card. 

Lost, Stolen, Unauthorized ActivityYou should tell us at once if your Card had been lost or stolen.  

If you believe your Card has been lost or stolen, call us immediately at 1-866-297-3613 or 1-866-931-2265; you may also write to us at Community Trust Bank Gift Card Services 1101 R. O. C. Lane, Ruston, LA  71270.  Telephoning is the best way to keep your possible losses down.

If a Card is lost or stolen, you will need to provide us with the information that confirms that you are the owner of the Card.  Therefore, you are encouraged to register the Card as soon as you receive it. 

Liability for Unauthorized use of a Lost or Stolen Card

If you have registered your card and you immediately notify us of the loss you will not be liable for the unauthorized use of a Lost or Stolen card.  If a Card is lost or stolen, in order to reimburse you for your loss, we will need to identify you as the owner of the card.  Therefore, you are encouraged to register the Card as soon as you receive it.

If you have not registered your card you will be liable for any loss which occurred due to a Lost or Stolen card.  If we can reasonably identify you as the owner of the card, the Bank will refund you any monies that remain on the card; but we would not be able to reimburse you for any loss due to any unauthorized use of the card.

Error Resolution

In case of errors or questions about transactions arising from the use of your Card call us at 1-866-931-2265 or write to us at Community Trust Bank Gift Card Services Attn: Gift Card Dispute   1101 R. O. C. Lane Ruston, La  71270.
In case of errors, we must hear from you no later than 60 days after the date of the transaction in question.  If you tell us orally, we may require that you send your request for error correction to us in writing.  For Error Resolution you must provide the following information: 

• Your name, Card number and Social Security number
• A description of the error
• The dollar amount of the suspected error
• Explain why you believe it is an error

If we determine that an error has occurred Community Trust Bank will promptly correct the error.  We will contact you within 10 business days of receiving your request for resolution.  In some instances, it may take up to 45 calendar days to investigate your complaint or question.  We will tell you the results after completing our investigation.  If we decide there was no error, we will send you a written explanation within three (3) Business days, after we complete our investigation.  You may ask for copies of the documents we used in our investigation.  

Card Expiration

We encourage you to use the entire gift amount before the "Valid Thru" date shown on the Card.  Any transactions that are attempted after the "Valid Thru" date will be declined.  If at the end of the "Valid thru" date shown on your Card there remains any unused balance, and you have registered as the owner of the card, you may present the Card to any Community Trust Bank banking center and, we will refund any monies that remain on your expired card at no cost.  This is a non-reloadable card.  Five (5) months after the expiration date on the card the funds remaining on the card will expire.  If you deplete the funds on the card before the expiration date, you may destroy the card; it will no longer be a valid card.

Cancellation

Your Card is issued by Community Trust Bank.  Community Trust Bank is the owner of the Card.  The Card will remain our property, we may cancel your right to use the Card at any time and have you return the Card to us.

Amendment

We retain the right to change the terms of this agreement without notice, unless required by law.  Changed terms will be posted on our website and will apply to the outstanding balance on your card as well as to any transaction after the date of the change.  In any event, the use of the Card after the date of the change will confirm your agreement to the change. 

Governing Law

This agreement is governed by applicable federal laws and regulation and, to the extent not preempted by federal laws and regulations, by the laws of the state of Louisiana.
